Identifying, Eliminating, and Avoiding Problems

Despite the enormous amount of attention given to DOL fee disclosure regulations (disclosures from service providers and to participants), plan administration “life” goes on. In addition to discussing new guidance on in-plan Roth rollovers, this year’s 401(k) Plan Current Issues Workshop targets some troubling and continuing issues facing administrators. 2011 FORM 5500/EFAST2 WORKSHOP

EFAST2 now allows the DOL to “target more accurately and effectively those plan filings we want to go after,” according to a DOL official. EFAST2 filings have revealed a number of issues on which the DOL is focusing, namely: plans that failed to file, missing audit reports, 403(b) plan compliance with the reporting requirements, eligibility to file Form 5500-SF, and proper values of plan investments that do not have a readily determinable fair market. 

For many preparers, EFAST2 procedures proved to be more difficult than the changes to the forms. In this year's Form 5500/EFAST2 Workshop, we identify the typical electronic filing issues and explain how to avoid and resolve the frustrating and time-wasting errors. Our Workshop also explains the 2009 and 2010 filing requirements for the revised Form 8955-SSA, including the IRS electronic procedures.

In addition to helping you understand the Form 5500 enforcement issues and EFAST2 filing procedures, we provide a thorough, line-by-line review of the Form 5500 and each schedule, particularly Schedule C. We help you learn how the new service provider disclosure regulations affect the Schedule C. We also help you learn the process for amending returns, the procedures for short plan year filings, PTIN application and exemptions, and the requirements to extend Forms 5500 and 8955-SSA filings.

This year’s 401(k) Plan Current Issues Workshop also revisits some continuing issues relating to rehired employees, and participant loan rules (with emphasis on the application of the lookback rule). In addition, the Workshop covers audit issues and audit avoidance by discussing IRS unofficial positions on practical 401(k) plan issues, as well as correction of 401(k) plan errors, including some of the rules for simplifying the correction process.

Finally, the Workshop explains (with actual sample statements and checklists) what additional fee information must be included in the quarterly benefit statement and how to draft and deliver the new annual fee and investment disclosures which will be effective later this year. As always, the programs use case studies to provide practical understanding to these complicated rules.
